The contentious law aims to replace the Delhi government’s legislation on senior officer transfers and placements.
With 131 votes in support and 102 against, the Rajya Sabha on Monday approved the administration of National Capital Territory of Delhi (Amendment) Bill, 2023, which would replace the ordinance governing senior officer transfers and postings in the Delhi administration.
Union home minister Amit Shah stated in response to the Rajya Sabha debate on the disputed bill that the law does not in any way contravene the Supreme Court’s ruling. The measure, according to Shah, aims to create efficient, corrupt-free government in the capital. Additionally, he gave the members the reassurance that not a single element in the bill alters the status quo of the system in place since the Congress regime
The minister defended the rule by claiming that officers of the vigilance department were transferred when liquor scam cases were with the AAP-led Delhi government.
He claimed that the Delhi administration had acted with such speed in relation to the vigilance department because it contained documents about the “excise policy scam” and the “sheesh-mahal.”
Shah claimed that once the Delhi services bill is enacted, AAP leader Arvind Kejriwal will leave the opposition group INDIA, taking a shot at the Congress for collaborating with the Aap Aadmi Party. According to him, the bill was not introduced to impose a “Emergency” or restrict people’s liberties.
“Before, there were no disputes in Delhi regarding transfer postings, and no CMs experienced any issues…After a “Andolan,” a government was established in 2015.The Centre, according to others, seeks to consolidate its influence. The Indian people have granted us the authority and the right, thus the Centre doesn’t need to take such action, according to Shah.
The law is a “political fraud, constitutional sin, and will create an administrative logjam,” according to AAP MP Raghav Chadha earlier today. According to Chadha, the BJP had pledged statehood for Delhi in its election manifesto and had been calling for it for almost 40 years. The AAP representative claimed that the BJP had undone the 40 years of labour that its leaders, including Atal Bihari Vajpayee and Lal Krishan Advani, had put into creating a fully functioning state of Delhi.
Taking jabs at Union Home Minister Amit Shah, who cited Jawaharlal Nehru as the bill’s inspiration, Chadha said the BJP leader ought to adopt the name “Adavanivadi” rather than “Nehruvadi.”
Abhishek Manu Singhvi, a member of Congress, rejected the measure and called it “completely unconstitutional” and “retrogressive.”
Additionally, he stated that it “violates federalism” and is a “frontal assault on the people of Delhi.”
Raghav Chadha’s “Moved by Drama over Motion”
When the opposition’s proposal to refer the disputed bill to a select committee was discussed in the House, a scene erupted. Some MPs, notably BJD MP Sasmit Patra and BJP MP Sudhanshu Trivedi, claimed that the motion introduced by AAP MP Raghav Chadha contained their names without their permission.
The manner in which the motion was signed is currently being investigated, Shah said.
A probe will be launched into complaints made by several Rajya Sabha MPs regarding the insertion of their names without agreement, according to deputy chairman Harivansh Narayan Singh.
The Lok Sabha approved the bill last week.
